1. Acceptance of Terms

By accessing or using AI Freelance Pricing ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

2. Description of Service

AI Freelance Pricing provides AI-powered pricing analysis, engagement tracking, and professional bio creation tools for freelancers. The platform uses artificial intelligence and marketplace data to generate pricing recommendations and professional content.

3. User Accounts

• You must provide accurate and complete information when registering
• You are responsible for maintaining the security of your account credentials
• One account per person; accounts are non-transferable
• You must be at least 18 years old to use the Service
• You are responsible for all activity that occurs under your account
• Notify us immediately if you suspect unauthorized access

4. Subscription & Billing

Premium features require a paid subscription processed through Stripe. By subscribing, you agree to the following:

• Billing occurs monthly or annually depending on your selected plan
• Subscriptions auto-renew unless you cancel before the renewal date
• You may cancel at any time; access continues until the end of your current billing period
• Price changes will be communicated at least 30 days in advance
• Refunds are handled on a case-by-case basis — contact support within 7 days of a charge for refund requests

Free-tier users have access to limited features as described on our pricing page. We reserve the right to modify free-tier limits with reasonable notice.

5. AI-Generated Content & Disclaimer

Pricing recommendations, marketplace analyses, and generated bios are produced using artificial intelligence and are provided for informational purposes only. They do not constitute financial, legal, or professional advice.

• You are solely responsible for your pricing decisions and business outcomes
• AI outputs may be inaccurate, incomplete, or outdated — always verify recommendations independently
• Marketplace data reflects publicly available information at the time of query and may not represent current conditions

6. Intellectual Property

Your content

You retain ownership of all data and content you submit to the platform (engagement records, bio text, form inputs). By using the Service, you grant us a limited license to process this content solely to provide the Service to you.

Our content

The platform's design, code, branding, and documentation are owned by Vyrtex Labs LLC and protected by intellectual property laws. You may not copy, modify, or redistribute any part of the platform without written permission.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or crawl the platform
• Share your account credentials with others
• Abuse API rate limits or attempt to circumvent usage restrictions
• Upload malicious content or interfere with the Service
• Use automated tools (bots, scripts) to access the Service without prior written consent
• Resell, redistribute, or sublicense access to the Service or its outputs

Violation of these terms may result in immediate suspension or termination of your account.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYRTEX LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Vyrtex Labs LLC and its team from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• You may cancel your subscription at any time through account settings or by contacting support
• We may suspend or terminate accounts that violate these Terms, with or without prior notice
• Upon termination, your right to use the Service ceases immediately
• We will retain your data for 30 days post-termination to allow recovery, after which it will be permanently deleted

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the applicable arbitration association in the jurisdiction of the Service provider.

You agree to resolve disputes on an individual basis and waive any right to participate in class actions.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. General Provisions

• If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
• Our failure to enforce any right does not constitute a waiver of that right
• These Terms constitute the entire agreement between you and Vyrtex Labs LLC regarding the Service
